Martin Spencer QC and Dr Tejina Mangat secure judgment for claimant in High Court negligence claim 

December 2010 - In the case of Fallon v Wilson [2010] EWHC 2978 (QB) it was alleged that care fell short of the standard expected when a GP failed to refer a premature baby to hospital, following a consultation in which she had exhibited symptoms that justified a hospital referral.

Martin Spencer QC, acting as lead counsel for the Claimant, asserted that the Hertfordshire based GP, ought to have spotted the warning signs that something serious was wrong, and that a "vital hour was wasted".

In the judgment handed down in November by Mr Justice Eady, the court held that a 14-year-old girl was left with acute disability as a result of a GP's negligence.

The level of compensation is yet to be decided but given the Claimant's need for 24-hour care for life, the value of the award is expected to be several million pounds.
