Bernard has acted for and against accountants, barristers & solicitors, financial advisers and brokers, construction professionals, surveyors & valuers and medical practitioners.

 

Accountants and auditors

Over a number of years Bernard has acted for or against accountants for breach of their professional duty, including breach of accountancy procedures, failure to give appropriate taxation and investment advice and advice on domicile.

 

Construction professionals

Bernard has regularly acted in the TCC doing construction work, including actions for or against architects, engineers and surveyors for breach of duty: Architects, for failures in the co-ordination of works, in the design of buildings and other structures, in the selection and use of inappropriate materials, in the supervision and approval of defective works: Engineers: for failure to assess ground conditions and for failures in the design of a sewage works, appropriate piling schemes, machinery, flooring and other structures.

 

Financial professionals

Bernard acts for or against financial services professionals including for failure to provide appropriate advice in the selection of pensions and other investment schemes.

 

Insurance brokers

Bernard has a substantial insurance practice and also acts for or against insurance brokers for breach of duty, including failures to select appropriate insurance cover, obtain from the client appropriate information, give appropriate advice on disclosure of material fact, the scope and limitations of the cover under different policies and the failure to give of notice of claims.

 

Lawyers

Bernard has considerable experience of defending barristers and acting for or against solicitors for fraud and/or breach of duty: including disputes where the issues include the scope of duty, causation and loss of chance and the apportionment of liability amongst professionals of different expertise. He also acts on coverage issues arising between solicitors and their insurers under the Minimum Terms & Conditions and other policies.

 

Surveyors & valuers

Bernard has acted for and against valuers where there has been an allegation fraud and/or breach of duty: including in particular where there has been alleged overvaluation of substantial commercial and/or residential property and development schemes.  He also acts on coverage disputes arising between valuers and their insurers.
