Arbitration & mediation

Bernard is experienced in the arbitration of professional liability, construction and insurance issues. He has taken a number of arbitral awards on appeal to the High Court pursuant to section 69 of the Arbitration Act 1996. He has acted as an arbitrator in professional liability and insurance issues. As a Deputy High Court Judge in the QB and Chancery Divisions he has for a dozen years presided over interlocutory and substantive trials, handing down judgment in a wide variety of cases, including Edo Corporation v. Ultra Electronics Limited [2009] EWHC 862 (Ch), where he rejected a contention that a party had an entitlement in arbitral proceedings to pre-action discovery.
