Recent cases

  • T v Surrey & Sussex Healthcare NHS Trust LTLPI 6/6/2011 The Claimant asserted that the Defendant had been negligent in performing a cervical cerclage and thereafter failing to remove the stitch once infection had set in. Liability was admitted and T was compensated in an out of Court settlement on the basis that as a result of the infection she sustained a collapsed uterus, lost her unborn child and suffered from chronic post-traumatic stress disorder.

  • G v Secretary of State for Health [2009] 1619 PVA & [2009] 1620 PC - Successfully represented a registered nurse in an appeal against her inclusion on the PoVA/PoCA lists (barring her from working with children and vulnerable adults). Despite previous disciplinary findings the Care Standards Tribunal found that the Secretary of State had failed to prove any of the factual allegations against her. The Tribunal found that she was "entirely suitable" to practice with vulnerable [patients].
