The claimant's case on both breach of duty and causation was rejected by the High Court (HHJ Seymour QC).

  • London Borough of Wandsworth v Nicholson: successfully resisting a challenge under Article 8 of the European Convention on Human Rights to the local authority's claim for possession against squatters. HHJ Knowles accepted the Claimant's arguments that such a challenge was impermissible and would circumvent the statutory scheme for homelessness provision laid down by Parliament.
